1. Interpretation and Definitions
For the purposes of these Terms of Service, the following definitions apply:
Company, we, us, or our refers to KUMA, the developer of the Applications.
Application or App means any mobile application developed, published, or offered by KUMA.
Services means any services provided by the Company through the Application.
User, you, or your means the person or entity using the Application or accepting these Terms.
Subscription means a recurring payment plan (e.g., monthly or annual) that grants access to premium features or content, if the Application offers such a plan.
In-App Purchases means optional purchases of content, features, or services available within the Application.
Privacy Policy refers to the KUMA Privacy Policy available at https://kuma-privacy.carrd.co, which is incorporated into these Terms by reference and governs the collection and use of your personal information by the Company.2. Acceptance of Terms
By downloading, installing, accessing, or using any KUMA Application (the “Application”), you agree to be bound by these Terms of Service and any terms incorporated by reference, including the Privacy Policy. If you do not agree to these Terms, do not download or use the Application. You represent that you are at least the age of legal majority in your jurisdiction (at least 13 years old in most jurisdictions). If you are using the Application on behalf of another person or entity, you must have the legal authority to accept these Terms on that person’s or entity’s behalf. Minors (under 18 years of age, or the age of majority where you live) may use the Application only with the involvement and consent of a parent or legal guardian. Your use of the Application may also be subject to terms of any platform or service from which you obtained the Application. For example, if you access the Application through Apple’s App Store, you agree to the Apple Media Services Terms of Use and any other applicable Apple terms. If you access the Application through Google Play or another platform, you agree to comply with that platform’s terms.3. License to Use the Application
Subject to your compliance with these Terms, KUMA grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the Application on your personal devices solely to access and use the Application in accordance with these Terms. This license is for your personal, non-commercial use only. You may not distribute or make the Application available over a network where it could be used by multiple devices at the same time or by multiple users. You agree not to:
Copy, modify, or create derivative works based on the Application (except as permitted by your device’s operating system and only if you own or control the device on which the Application is installed).
Sell, resell, rent, lease, sublicense, distribute, or otherwise make the Application available to any third party.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
Bypass or circumvent any features or content protections of the Application.
Remove or alter any proprietary notices (e.g., copyright or trademark notices) from the Application.
Use the Application for any commercial or non-personal purpose unless explicitly authorized in writing by KUMA.
Use the Application in any manner that could disable, overburden, damage, or impair the App or its infrastructure.
All rights not expressly granted to you in these Terms are reserved by KUMA and its licensors. If you violate any of these restrictions, your rights to use the Application will automatically terminate without notice, and you must immediately cease all use of the Application.4. Ownership and Intellectual Property
The Application, including all content, features, functionality, designs, graphics, interfaces, and other materials (“App Content”) provided in or through the Application, is owned by KUMA and its licensors. All intellectual property rights, including copyrights, trademarks, service marks, trade dress, and any other proprietary rights, in the Application and App Content are owned by KUMA (or its licensors). Except for the limited license granted to you above, KUMA (and its licensors) retain all right, title, and interest in and to the Application and all App Content. You may not copy, publish, distribute, modify, or otherwise use App Content except as expressly authorized by KUMA in writing. The names, logos, and trademarks identifying KUMA or the Application are the property of KUMA; no right or license is granted to use them.5. Subscriptions (If Applicable)
Subscription Plans. Some Applications may offer subscription plans or recurring billing for access to premium features or content. If you choose to sign up for a subscription, you agree to pay the recurring fees (monthly, annual, or as otherwise indicated) at the then-current rates. Subscription fees (plus any applicable taxes) will be charged automatically through the platform from which you purchased the subscription (for example, your Apple App Store or Google Play account). Auto-Renewal. Unless you cancel before the end of the current subscription term, your subscription will automatically renew for an additional term of equal length. You can cancel or turn off auto-renewal at any time through your account settings on the App Store or Google Play (or other relevant platform). It is your responsibility to cancel before the next billing date if you do not wish to continue your subscription. Free Trials (If Offered). If you receive a free trial or promotional subscription period, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. KUMA reserves the right to modify or terminate free trials at any time. If you cancel during a free trial period, you will lose access to the trial content immediately (unless otherwise specified) and will not be charged at the end of the trial. No Refunds. We do not provide refunds or credits for any partial subscription period, cancellation, or unused portions of the subscription, except where required by applicable law. Payment Methods. You agree to provide accurate payment information when subscribing to any paid service. All purchases or subscriptions through the Application are charged in advance and are non-refundable, except as required by law or as expressly set forth in these Terms. Taxes. You are responsible for payment of all taxes and duties, including any value-added, sales, use, goods and services, or other taxes related to your purchases or subscriptions (unless exempt by law). If KUMA is required to collect taxes in connection with your purchase or use of the Application, the applicable taxes will be added to the charges in your billing. Billing Issues. If you believe there is an error or unauthorized charge on your account, you must contact us promptly at [email protected]. We may request additional information or documentation to address your inquiry.7. Refunds and Cancellations
Except where expressly required by applicable law, all purchases of subscriptions or in-app products are final and non-refundable. If you cancel a subscription, your access to paid features will continue until the end of your current paid subscription period, and you will not receive a refund for that period. After cancellation, the subscription will not renew, and you will lose access to any premium content or features at the end of the billing cycle. If you believe you are entitled to a refund under applicable law, you may contact us at [email protected] with proof of purchase and explanation. We will review refund requests in accordance with applicable laws and this policy. To cancel a subscription, you must do so through the platform (App Store, Google Play, or other service) used to purchase the subscription. Cancelling through the Application itself or contacting KUMA may not automatically cancel your subscription or stop future payments.8. Third-Party Content and Links
The Application may include content, advertising, or features that link to third-party websites, services, or applications (collectively, "Third-Party Content"). You acknowledge and agree that KUMA is not responsible for any Third-Party Content, including any data, content, products, or services offered by third parties. Third-Party Content is provided "as is," without any warranty from KUMA. If you interact with any third-party link or content, you do so at your own risk. Any dealings with third parties (including payment for products or services) are between you and the third party, and KUMA will have no liability. We do not endorse or make any representations or warranties about any third-party products or services, and we do not manage or control those websites or content. Some features of the Application may allow interactions with third-party services or content, and those interactions may require you to comply with the third party’s terms. For example, social media sharing or content embedding features may require separate logins. KUMA is not responsible for the privacy practices, policies, or terms of any third party.9. User-Generated Content
If the Application allows you to upload, submit, or post any content (such as text, images, audio, or designs) to the App ("User Content"), you retain all ownership rights in your User Content. By submitting User Content to the Application, you grant KUMA a worldwide, royalty-free, transferable, sublicensable, non-exclusive license to use, copy, modify, and display your User Content solely for the purpose of operating and improving the Application and its services. For example, we may display your content to other users if the Application includes a social or community feature. You represent and warrant that you own all rights in your User Content or have obtained all necessary permissions to grant this license. You further warrant that your User Content does not violate any law or the rights of any third party (including intellectual property, privacy, or publicity rights). You agree not to post any content that is unlawful, defamatory, obscene, harassing, or infringes any rights. KUMA reserves the right to remove or disable any User Content at our discretion, especially if we believe it violates these Terms. We do not endorse and are not responsible for any User Content, and any use of User Content is at your own risk.10. Restrictions on Use
You agree not to use the Application for any unlawful purpose or in a way that could harm or disrupt the Application or others’ use of it. Specifically, you will not:
Use the Application in violation of any law or regulation, including export laws.
Harass, stalk, threaten, or harm other users.
Upload, post, or transmit any viruses, malicious code, or other harmful content.
Attempt to decompile, reverse engineer, or copy any part of the Application (except as permitted by law).
Interfere with or disrupt the Application, servers, or networks.
Transmit unsolicited advertising or spam.
Post content that is illegal, defamatory, obscene, pornographic, or hateful.
Upload content that infringes others’ intellectual property or privacy rights.
Remove or modify any proprietary notices in the Application.
Use any automated means (such as bots, scripts, or scrapers) to access the Application.
KUMA reserves the right to suspend or terminate your access to the Application if we believe you have violated these restrictions.11. Privacy Policy
Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how KUMA collects, uses, and discloses your personal information. By using the Application, you agree to the terms of the Privacy Policy.12. Termination
KUMA may suspend or terminate your license and access to the Application at any time for any reason, including if you violate these Terms or any applicable law. Upon termination of these Terms or your access to the Application, your license to use the Application will immediately cease, and you must stop using and delete all copies of the Application. We reserve the right to delete or disable your account, content, or access if you violate our policies. Even after termination, Sections related to intellectual property, warranty disclaimers, liability limitations, indemnity, and dispute resolution will continue to apply to any past usage and to the handling of outstanding obligations.13. Disclaimer of Warranties
THE APPLICATION IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND. KUMA EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. KUMA does not guarantee that the Application will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We also do not warrant that the results of using the Application will be accurate or reliable. You acknowledge and agree that your use of the Application is at your sole risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you.14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL KUMA OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF KUMA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. KUMA’ TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APPLICATION SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU (IF ANY) FOR THE APPLICATION OR USD $100, WHICHEVER IS LOWER. This limitation applies even if KUMA has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of certain types of damages, so these limitations may not apply to you.15. Indemnification
You agree to defend, indemnify, and hold harmless KUMA and its affiliates, licensors, and service providers, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:
Your violation of these Terms;
Your User Content, including any claim that your User Content infringes a third party’s rights;
Your use of the Application or any content, data, information, or services that you obtain through the Application.
This indemnification obligation will survive the termination of these Terms and your use of the Application.16. Updates to the Service
KUMA may provide updates, upgrades, patches, or other modifications to the Application that must be installed for continued use. We do not guarantee that any updates or new features will be released or will maintain compatibility with previous versions. You agree that KUMA has no obligation to provide maintenance, support, or to continue to provide or enable any particular features or functionality of the Application. Notwithstanding anything to the contrary, KUMA reserves the right to modify, suspend, or discontinue the Application (or any portion thereof) at any time, with or without notice to you.

17. Changes to Terms of Service
KUMA may revise these Terms from time to time in its sole discretion. If we make material changes to these Terms, we will notify you (for example, by posting a notice within the Application or sending you an email) prior to the change becoming effective. Your continued use of the Application after such notice will constitute your acceptance of the updated Terms. It is your responsibility to review these Terms periodically for changes. If you do not agree to the revised Terms, you may remove or stop using the Application. These changes will not retroactively affect rights and obligations already accrued prior to the change.18. Governing Law and Jurisdiction
These Terms and your use of the Application will be governed by and construed in accordance with the laws of Denmark, without regard to conflict of law principles. Any dispute arising from or related to these Terms or the Application will be subject to the exclusive jurisdiction of the courts of Denmark. You agree that the United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms. If any part of this provision is deemed invalid by a competent court, the remaining provisions will remain in effect.19. Severability
If any provision of these Terms is held to be unlawful, void, or unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. The invalid provision may be replaced by a valid provision that most closely reflects the parties’ original intent.20. Waiver
No failure or delay by KUMA in exercising any right under these Terms will operate as a waiver of that right. Any waiver of any provision will be effective only if in writing and signed by KUMA. The waiver of a breach of any provision will not operate as a waiver of any subsequent breach.21. Entire Agreement
These Terms constitute the entire agreement between you and KUMA regarding the Application and supersede and replace any prior agreements or communications, both written and oral. In the event of any conflict between these Terms and any additional terms or policies incorporated herein by reference (including the Privacy Policy), the terms of this Agreement will prevail.22. Assignment
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without KUMA’ prior written consent. KUMA may assign or transfer its rights and obligations under these Terms without restriction. Any purported assignment in violation of this Section is void.23. Feedback
If you send or transmit any ideas, suggestions, or other feedback to KUMA regarding the Application ("Feedback"), you agree that KUMA is free to use and exploit such Feedback without any obligation to you. By submitting Feedback, you assign to KUMA all intellectual property rights in it. KUMA may treat Feedback as non-confidential and non-proprietary.24. Notices
All notices, consents, and communications under these Terms must be in writing. KUMA may provide notice to you by posting a notice within the Application or by sending you an email at the address you provided. For notices to KUMA, you should send an email to [email protected]. Notices will be deemed given when received (for example, when an email is delivered). You agree to receive notices electronically and waive any requirement for written notice where not required by law.25. Force Majeure
KUMA will not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond its reasonable control (including acts of God, natural disasters, war, terrorism, riots, labor disputes, government actions, or failures of the Internet or power supply). In such an event, KUMA’ obligations are suspended for the duration of the force majeure event.26. Independent Parties; No Agency
You and KUMA are independent parties and nothing in these Terms will be deemed to create an employment, agency, joint venture, or partnership relationship between you and KUMA. Neither party has any authority to act on behalf of the other except as expressly set forth in these Terms.27. Miscellaneous
These Terms (including the Privacy Policy) constitute the entire agreement between you and KUMA with respect to the Application, and supersede all prior understandings. There are no third-party beneficiaries to these Terms. If any provision of these Terms is held invalid, the remaining provisions will remain in full force. Section headings are for convenience only and do not affect interpretation. The word “including” and similar terms are not limiting (they mean “including, without limitation,”). Rights and remedies under these Terms are cumulative and do not exclude rights provided by law.28. Contact Us
